PocketCal AI Services Supplemental Terms

These supplemental terms serve as an addendum to the Apple Standard End User License Agreement (EULA) and the iPocket Studio General User Agreement, specifically governing the AI service features within the PocketCal application.

1. Scope and Relationship to Other Agreements

1.1 Status of These Supplemental Terms

  • These supplemental terms (the “AI Services Supplemental Terms”) specifically govern your rights and obligations when using the AI features provided by iPocket Studio (“we,” “us,” or “our”) within the PocketCal application.
  • These Supplemental Terms, together with the Apple Standard EULA and our General User Agreement, constitute the complete legal binding. In case of conflict between these Supplemental Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail; in case of conflict between these Supplemental Terms and the General User Agreement regarding AI services, these Supplemental Terms shall prevail.

1.2 Definition of AI Services

The “AI Services” referred to in these Supplemental Terms include but are not limited to:

  • Food recognition and nutritional calculation via photo or text input;
  • AI Nutrition Assistant (intelligent Q&A based on RAG technology);
  • Personalized meal plan generation;
  • Other AI-powered intelligent analysis and recommendation features.

2. AI Service Usage Quotas

2.1 Subscribed Users

Users with an active subscription (monthly or annual) (“Subscribed Users”):

  • Are guaranteed at least 30 uses of AI Services per day;
  • Actual available quota may vary depending on subscription tier, as detailed within the app;
  • We reserve the right to adjust daily quotas within reasonable limits based on service capacity or system maintenance needs, but not below the guaranteed minimum stated above.

2.2 Free Users

Non-subscribed free users (“Free Users”):

  • Generally receive 3 uses of AI Services per day;
  • This quota is not guaranteed and may be adjusted or revoked based on system load, resource availability, or operational policies;
  • We may periodically offer additional free trial uses or promotional quotas, subject to in-app announcements.

2.3 Lifetime Purchase Users

Users who have made a one-time lifetime purchase (“Lifetime Users”):

  • Generally receive 20 uses of AI Services per day;
  • This quota is not guaranteed and may be adjusted based on system load, resource availability, or operational policies;
  • Lifetime authorization guarantees lifetime use of the app’s core features only and does not guarantee permanent fixed AI service quotas.

2.4 Quota Reset and Calculation

  • Daily quotas reset at UTC 00:00 (08:00 Beijing Time) each day;
  • Unused quotas do not carry over to the next day;
  • Each AI feature invocation (e.g., one photo recognition, one Q&A query) counts as one use;
  • Failed calls due to network errors or service failures generally do not count toward usage, but we make no guarantees regarding this.

3. Service Availability and Disclaimers

3.1 Nature of Service

  • AI Services rely on third-party AI service providers (e.g., OpenAI, Google Gemini, etc.);
  • We do not guarantee the continuous availability, accuracy, or real-time performance of AI Services;
  • AI-generated nutritional data, recommendations, and plans are for reference only and do not constitute professional medical, nutritional, or health advice.

3.2 Service Interruptions

AI Services may be temporarily unavailable under the following circumstances, for which we bear no liability:

  • Service interruptions, rate limiting, or termination by third-party AI service providers;
  • System maintenance, upgrades, or security updates;
  • Force majeure events (e.g., natural disasters, network failures, changes in laws or regulations);
  • Technical failures beyond our reasonable control.

3.3 Accuracy Disclaimer

  • AI identification of food, calorie calculations, and nutritional analysis may contain errors;
  • AI-provided recommendations cannot replace advice from professional nutritionists, doctors, or other healthcare professionals;
  • You should exercise your own judgment and assume full responsibility for your use of AI Service outputs.

4. Data Processing and Privacy

4.1 AI Data Processing

  • When you use AI Services, your input content (such as food photos, text descriptions, Q&A content) may be transmitted to third-party AI service providers for processing;
  • We collect only the data necessary to provide the service and implement appropriate security measures to protect your data;

4.2 Third-Party Terms of Service

When using AI Services, you should also comply with the terms of use and policies of the relevant third-party AI service providers.

5. Prohibited Conduct

When using AI Services, you must not:

  • Attempt to circumvent or bypass usage limits;
  • Use automated tools or scripts to make bulk AI Service calls;
  • Input false, misleading, or malicious content;
  • Use AI Service outputs for commercial purposes (unless otherwise authorized);
  • Attempt to reverse engineer, probe, or test vulnerabilities in the AI Services;
  • Engage in any conduct that may impair the stability or security of AI Services.

Violation of these provisions may result in suspension or termination of your access to AI Services, with no liability on our part.

6. Changes and Termination

6.1 Changes to Terms

We may update these Supplemental Terms from time to time. Material changes will be communicated through in-app announcements or release notes. Updated terms take effect upon publication. Continued use of AI Services constitutes your acceptance of the updated terms.

6.2 Service Changes and Termination

  • We reserve the right to modify, suspend, or terminate AI Services (in whole or in part) without prior notice;
  • For material changes or termination, we will make reasonable efforts to provide advance notice;
  • Upon service termination, unused AI service quotas are non-refundable and non-exchangeable.

7. Relationship with Apple

  • Apple is not the provider of AI Services and bears no responsibility for them;
  • In case of conflict between these Supplemental Terms and any Apple policies or terms, Apple’s policies or terms shall prevail;
  • Apple and its subsidiaries are third-party beneficiaries of these Supplemental Terms and have the right to enforce terms relating to them.
